NewMe Yoga Terms and Conditions
All customers registering with NewMe Yoga agree to the following terms and conditions:
Class schedule and registration
NewMe Yoga (“The studio”) works hard to ensure all classes are held according to the schedule and we will endeavor to give notice before making any changes. However, the schedule is subject to change and classes can be canceled without notice. The studio is not liable to refund or offer compensation for any classes that are late, changed, or canceled for any reason, but will offer the student to book another class for no extra charge. All classes - whether access through a class pass or monthly membership - require booking ahead of time using the schedule hosted by Momoyoga, to ensure availability.
Class Passes
All class passes expire 12 months from the date of purchase.
NewMe Yoga Monthly Studio Membership
Monthly memberships auto-renew using the method of payment registered via Momoyoga. The membership allows unlimited classes each week, provided the customer books the class ahead of time to ensure availability. The membership excludes guest teachers, workshops or other special events.
Our monthly members are not charged for not showing up to a class they have booked, but we ask you to be mindful when scheduling and respect the class and teacher by making every effort to come to class. Four hours notice is the preferred cancellation time frame.
The monthly membership can only be used by one person - the registered customer who purchased the membership.
Cancellation Policy
Class Passes
Any reservations that are canceled within 4 hours before class start time are considered a late cancellation and the pass will be used and unavailable for future use. It is the customers responsibility to cancel a booked class through the Momoyoga system within the 4-hour time frame to avoid forfeiting the pass.
Special Events
Cancellation for attending special events is subject to the rules described in the participation agreement for each event.
Purchase Policy
All classes and services must be purchased online ahead of time, using the Momoyoga system. Customers will be asked to register and purchase online before attending the class. A mobile phone app can be used to access the Momoyoga system.
Gift vouchers
Gift vouchers are non-refundable and cannot be transferred to cash, however we are happy to transfer the gift voucher to another member or new student.
Privacy Policy
NewMe Yoga respects your personal information and will not sell it at any time to any person or business. All information sourced is for our business use only, and is used solely for the purpose of maintaining the client relationship with the studio, such as payments, and communication pertinent to participation in the studio’s activities. All information online is secure through Momoyoga and subject to privacy policies maintained by Momoyoga.
Liability Waiver
By registering a customer account with NewMe Yoga you are agreeing to the following:
Though unlikely, I understand that participating in any exercise class involves risk of injury; I agree that I am responsible for any injuries sustained by me as a result of my participation in this class (including prenatal) or any future classes I attend at NewMe Yoga. I understand that it is my responsibility to consult with a physician prior to my participation in any classes offered by NewMeYoga. If under 18 years old, I have the consent of my parent or guardian to participate in the activities.
Furthermore, I am voluntarily participating in all activities conducted by NewMe Yoga and I am participating in these activities entirely at my own risk. I am aware of the risks associated with traveling to and from the activity location, as well as participating in the activities, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including
paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others' negligence, conditions related to travel, or the condition of the activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this activity.
I agree to indemnify and hold harmless against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf.
I acknowledge that NewMe Yoga and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of NewMe Yoga.
I acknowledge that the activities may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, and instructors.
I acknowledge that I have carefully read this "waiver and release" and fully understand that it is a release of liability. I expressly agree to release and discharge and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against for personal injury or property damage.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of NewMe Yoga, its agents, and employees.
In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
